I acknowledge that I am voluntarily using the pool facilities and accept all risks associated with such use. RELEASE OF LIABILITY In consideration for being allowed to use the Massey community pool and related amenities, I hereby release, waive, and discharge Massey Homeowners’ Association, Inc., its Board of Directors, committees, management company, employees, agents, contractors, and pool management company from any and all claims, liabilities, damages, or causes of action arising from injury, loss, or damage that may occur while using the pool facilities, whether caused by negligence or otherwise. ASSUMPTION OF RESPONSIBILITY I agree to comply with all Massey HOA pool rules and regulations and acknowledge that failure to do so may result in removal from the pool area and potential suspension of privileges for the accompanying member. I understand that I must be accompanied by the Massey homeowner listed above while using the pool facilities. INDEMNIFICATION I agree to indemnify and hold harmless Massey Homeowners’ Association, Inc. and its representatives from any claims or damages arising out of my use of the pool facilities.
